Why You Might Need an Attorney: You have a lot invested in your home. Whether you're serving as a volunteer director or trying to influence the actions of your homeowners association, it takes time and effort to navigate the laws and caselaw affecting HOAs. If you have referred to the Condominium Bluebook (www.condobook.com) and considered other information found online, and you need more help, it may be time to hire an attorney. Most associations will need attorney advice at some point, including drafting and adopting association community rules and election rules, amending outdated governing documents, enforcing the rules, and initiating or responding to lawsuits and other claims.
Selecting an Attorney: Before I became an attorney, I had a small business managing six condominium associations. During that time, I sat in on many association board meeting, I managed association finances, and I assisted with calming and restoring positive relations between boards and owners. Shortly after becoming a California licensed attorney, I was hired to represent a plaintiff owner in a lawsuit against an HOA. The matter was settled amicable at mediation. In another case around the same time I was hired to represent an association through its elected board of directors who were defendants in a lawsuit. While most disputes won't go to trial, it is important to hire an attorney who is prepared for court, if necessary. Litigation law firms have some of the highest hourly billing rates. You want a well-rounded attorney that is also affordable.
